'Legal-Political Defense of Liberal Democracy': The successes of the AfD have brought the concept of 'militant democracy' back to the center of debate. Today's right-wing populist movements combine elements compatible with democracy with others that are illiberal and anti-pluralist. This raises the question of whether the legal strategies for protecting democracy devised in 1949 remain promising today. It is a matter of contention how divergent understandings of democracy influence these protective concepts; in this context, a distinction must be made between their legitimacy and their effectiveness. Furthermore, political exclusion must be precisely defined within the framework of the rule of law if the protection of democracy is not to inadvertently foster democratic erosion.
