»Objective Imputation: Act or Object of Judgment? From the Ambiguity of Objective Imputation to the Revision of the Concept of Imputation«: The »objective imputation« in criminal law has a hybrid form: On the one hand, it functions as a feature of the offense (object of judgment), on the other hand as a normative judgment (act of judgement). The study explains this logical ambiguity in terms of conceptual history. It then discusses it on the basis of the requirement of intent in the most recent case law of the Federal Court of Justice (4 StR 200 / 21). It concludes with some theses on a revision of the concept of imputation.
